Fall Retail Rush and Liability Risks for Business Owners

As fall approaches, many New Jersey retailers and small businesses experience an increase in customer traffic. The back-to-school season blends into early holiday shopping, and businesses that are unprepared can face serious liability risks.


Premises liability is one of the most common exposures during this time. With higher foot traffic, the likelihood of slip and fall incidents increases. Wet entryways, cluttered aisles, and poorly maintained parking lots all become hazards. Courts expect businesses to anticipate seasonal conditions, such as leaves or early snow, and to address them promptly. Failure to do so can result in costly claims.


Crowd control is another concern. Retailers holding seasonal promotions or sales must take reasonable steps to manage lines, monitor entrances, and avoid overcrowding. Incidents in which customers are injured during promotional events have resulted in litigation across the country. New Jersey courts expect businesses to implement reasonable safety measures when they know customer volume will increase.


Seasonal staffing can also create risk. Many businesses hire temporary workers during the fall months. These employees may not be adequately trained in safety procedures or customer service. A business that expands its hours, adds temporary staff, or hosts special events during the fall should confirm that its insurance coverage matches its operations.
